What
is a Process Server?
The
word process derives from the "Process" of law", the mechanism on which a court
case progresses. On many occasions for that process to continue one or more
parties involved in the case must be served with various documents and this is
known as Process Serving.
A
process server delivers various legal documents such as summonses, injunctions,
subpoenas, writs, witness orders, complaints, general orders and other
miscellaneous court documents to one or more of the parties involved in a court
case, which may be a; claimant, defendant, respondent, witness or other
individual in some way involved in the case.
When
serving process documents the legal process server must affect service whilst
complying with the court regulations and directions out of which they were
issued and with any other legislation in the area in which the service is to be
effected.
A
process server may be directly employed and empowered by the court such as a
Sheriff, Bailiff or Tipstaff. He may also be a professional private process
server such as a Private Detective directly engaged by a lawyer or other
individual.
